Well, a criminal defendant has a right not to testify, and if there is a failure of evidence on the part of the prosecution, then any defense lawyer would quit while he is ahead. If you are winning, there is no reason to say anything. So, if the defense case is looking good at the end of the prosecution case, if they have done enough to cast doubt on what this woman says, then there is a good chance they will not call Kobe Bryant to the stand. Now on the other hand, Kobe has a public image he might be concerned about and he might say that he wants to take the stand. That will be between him and his defense lawyers, but if there is a failure of evidence on the part of the prosecution, I don’t think they will be calling Kobe Bryant as a witness.
